Pemidanaan terhadap Pelaku Penyebaran Konten Pornografi Digital melalui Media Sosial dalam Perspektif Hukum Pidana Kontemporer

This article analyzes the regulation and enforcement of criminal provisions against perpetrators who disseminate digital pornographic content through social media in Indonesia, using a contemporary criminal law perspective. The study examines three main legal instruments Law No. 44/2008 on Pornography, Law No. 19/2016 amending Law No. 11/2008 on Electronic Information and Transactions (ITE Law), and the Indonesian Criminal Code (both the former KUHP and the new KUHP 2023). These regulations collectively govern the creation, distribution, and accessibility of pornographic materials in digital formats, while also addressing conduct carried out through electronic systems. In line with developments in communication technology, the article discusses the expansion of delict scopes, modern forms of criminal liability, and the effectiveness of penalties imposed on digital offenders. Issues such as anonymous accounts, encrypted platforms, cross-border content circulation, deepfake pornography, and non-consensual content highlight the need for a more adaptive penal model. Contemporary criminal law emphasizes not only punitive sanctions but also preventive mechanisms, technological cooperation, and victim protection.
