Analysis of the Absolute Authority of the District Court to Legally Carry Out the Case of Application for Cancellation of Death Certificate

Based on the Indonesian legal system, this paper attempts to examine the District Court's absolute jurisdiction in addressing claims for death certificate revocation. The primary issue under investigation is the ambiguous jurisdiction, considering that death certificates are a government administrative product with civil consequences, there is a dispute between the State Administrative Court and the District Court over their revocation. This research employs normative legal methods, incorporating legislative and conceptual approaches, as well as analytical descriptive research. The 1945 Constitution, Law No. 48 of 2009 concerning Judicial Power, Law No. 5 of 1986 concerning the State Administrative Court, and other relevant regulations are examples of primary legal resources that serve as data sources. Books and journals are examples of secondary legal materials that are available. Data collection was carried out through literature studies and interviews with the Judge of the Lamongan District Court. The study's findings demonstrate that, in accordance with Law No. 48 of 2009, which grants jurisdiction in civil proceedings, the District Court has the sole and rightful competence to consider applications for the revocation of death certificates, the philosophical aspects of civil registration in the Civil Code, and Law No. 5/1986's Article 2 Letter (a) provisions which excludes civil law acts from the state Administrative Court's jurisdiction. The conclusion of the study confirms that the cancellation of a death certificate that concerns a person's civil status is the District Court's supreme authority with strong legal legitimacy.
