Normative Conflict of 95-Year Cultivation Rights in the Nusantara Capital City under Indonesian Agrarian Law

The 190-year cultivation rights policy, divided into two 95-year cycles under Law Number 21 of 2023 amending Law Number 3 of 2022 concerning the Nusantara Capital City, contradicts the Basic Agrarian Law. The Basic Agrarian Law prioritizes distributive justice, ecological sustainability, and the supremacy of people's sovereignty over land. This normative inconsistency creates legal uncertainty in the economic sector, necessitating policy harmonization to ensure legal coherence. The two-cycle cultivation rights system may trigger monopolistic practices and disparities in justice due to excessive duration of control. This mechanism enables investors to manage land contrary to principles of social equality and state autonomy enshrined in the Basic Agrarian Law. This study analyzes the policy`s compatibility with Basic Agrarian Law principles, examining its implications for land ownership rights and ecosystem sustainability in the Nusantara Capital City region through normative legal research methods using the Statute Approach. Harmonization the Nusantara Capital City Law and the Basic Agrarian Law is imperative to prevent legal uncertainty, protect the collective interests of the community, and ownership and rights management grounded in agrarian justice principles.
