Abstract

The termination of an investigation by investigators from the Indonesian National Police (Polri) is a manifestation of legal authority in the early stages of the criminal justice system. This authority, although normatively legitimate, has the potential to raise serious issues related to legal certainty and human rights protection if not exercised based on the principle of due process of law. This article aims to analyze the application of the principle of legal certainty in the termination of an investigation based on a police report by placing it within the framework of legal substance, legal structure, and legal culture. This study uses a normative legal research method with a statutory, conceptual, and systemic approach. The results show that normatively, the termination of an investigation has a relatively adequate legal basis, but there are still gaps in technical regulations, weak standards of objectivity, and low procedural transparency. These conditions have an impact on the less-than-optimal guarantee of legal certainty and due process of law for the parties. Therefore, it is necessary to reconstruct the regulations and practices of investigation termination that are oriented towards accountability, legal rationality, and the protection of citizens' constitutional rights.
