Legal Analysis of the Validity of Certificates of Ownership (SHM) with Legal Defects (Case Study of Decision Number: 252/PK/PDT/2024)


Abstract
In the field, there are many cases that show that Land Rights Certificates can be sued through the Court, one of which is as in case Number: 252 PK/PDT/2024. This study examines the Ratio Decidendi of Judges in deciding cases against the validity of Legally Defective Certificates of Ownership (SHM), and examines the legal consequences of the validity of Legally Defective Certificates of Ownership (SHM), as in Decision Number: 252 PK/PDT/2024. This research uses normative research methods, with statutory and case approaches. The results showed that the Ratio Decidendi of the Panel of Judges in the Examination of Judicial Review Case Number 252 PK/PDT/2024 was correct and correct. According to the researcher, the reasons of the Petitioner for Judicial Review cannot be justified, and the Decision of the Supreme Court in the case of Judicial Review is appropriate. The legal effect of the Supreme Court Decision on Judicial Review Case Number 252 PK/PDT/2024 is that the Certificate of Ownership which is the object of the dispute is declared legally defective, so that it does not have binding legal force.
